Categorical Exclusion for Advanced Nuclear Reactors
Published Date: 2/2/2026
Notice
Summary
The Department of Energy is making it easier and faster to approve and manage advanced nuclear reactors by creating a special rule called a categorical exclusion. This means certain projects won’t need lengthy environmental reviews, saving time and money for companies building these reactors. The new rule kicks in on February 2, 2026, and the DOE wants your thoughts by March 4, 2026.

NEPA Exemption for Advanced Reactors
Starting February 2, 2026, DOE added categorical exclusion B5.26 so that authorization, siting, construction, operation, reauthorization, and decommissioning of certain advanced nuclear reactors normally do not require an environmental assessment or environmental impact statement under NEPA if DOE determines the project meets specified conditions. The two explicit conditions are: (1) the project's attributes (including potential fission product inventory, fuel type, reactor design, and operational plans) sufficiently reduce the risk of adverse offsite consequences from release of radioactive or hazardous materials; and (2) the project demonstrates that hazardous waste, radioactive waste, or spent nuclear fuel can be managed in accordance with applicable requirements.
Exclusion Limited by Conditions and Exceptions
DOE will apply the categorical exclusion only after it evaluates the categorical-exclusion conditions together with the 'integral elements' in appendix B of DOE's NEPA procedures and determines no extraordinary circumstances exist. If the conditions or integral elements are not met, DOE may still require an environmental assessment or environmental impact statement for the project.
Possible Deployment on Department of War Sites
DOE consulted with the Department of War (formerly the Department of Defense) about applying this categorical exclusion to potential future siting, construction, and operation of advanced nuclear reactor technologies on Department of War installations to accelerate deployment of resilient power solutions for mission assurance and to ensure military readiness.

The delay gives DOE more time to review feedback and make sure everything’s fair and square before making any big changes.
2026-10600 — Standards for Business Practices of Interstate Natural Gas Pipelines
Starting July 27, 2026, interstate natural gas pipelines must follow new rules that make sharing important gas-electric coordination info easier during cold snaps or emergencies. Pipelines need to file compliance paperwork by September 1, 2026, and fully follow the new standards by January 1, 2027.
2026-10505 — Commission Information Collection Activities (FERC-725J) Comment Request; Extension
FERC is extending its info collection about the 'bulk electric system' for another three years with no changes. This affects electric companies who report system details, but there’s no new cost or extra paperwork. You can still share your thoughts by June 26, 2026, so don’t miss out!
2026-10483 — Energy Conservation Program: Notification of Petition for Waiver of Zhuhai Samyou Environmental Technology Co., Ltd. From the Department of Energy Walk-In Coolers and Walk-In Freezers Test Procedure and Notification of Grant of Interim Waiver
Zhuhai Samyou Environmental Technology asked the Department of Energy to let them use a different way to test their walk-in coolers and freezers. The DOE said yes for now and wants to hear what people think before making a final call. This means Samyou can keep selling their products while everyone figures out the best testing method, with comments due by June 26, 2026.
2026-10498 — Revisions to the Blanket Certificate Program
The Federal Energy Regulatory Commission wants to make it easier and faster for interstate natural gas pipelines to build certain projects by expanding what they can do without special approval and raising the cost limits. This means pipeline companies can save time and money on smaller projects. If you have thoughts, you’ve got until July 27, 2026, to speak up!
