Importers: Request Duty Reviews Before Deadlines Hit

Deadline to Request Review or Keep Deposit Rate

If you import goods covered by the listed antidumping (AD) or countervailing duty (CVD) orders, you may request an administrative review not later than the last day of April 2026. If Commerce does not receive a request by that date, U.S. Customs and Border Protection (CBP) will be instructed to assess duties on those entries at the cash deposit rate that was required at the time of entry.

Timing for Particular Market Situation Claims

If you want Commerce to consider a particular market situation (PMS) under section 773(e) that could change constructed-value dumping calculations, you must submit the PMS allegation and supporting factual information no later than 20 days after submitting initial Section D responses. If Commerce finds a PMS exists, it will modify dumping calculations accordingly.

Nonmarket-Economy (NME) Entity Review Rule

Commerce will not consider the nonmarket-economy (NME) entity as an exporter subject to automatic administrative review; the NME entity will only be under review if Commerce receives a specific request or self-initiates one. If an individual exporter in an NME proceeding does not qualify for a separate rate, Commerce will treat it as part of the NME entity and the NME entity's rate will not change absent a review of the NME entity itself.

Fast Timeline for Respondent Selection

Commerce will select respondents for review using CBP import data and will release that CBP data under an administrative protective order (APO) to parties with an APO within 5 days of the initiation notice, and make the respondent selection decision within 35 days. Parties wishing to comment on selection should submit APO applications and comments quickly because Commerce invites comments within 5 days of placing the CBP data on the record.

Annual Inquiry Service List Update Window

Commerce will update annual inquiry service lists for the listed orders; interested parties must submit new or amended entries of appearance within 30 days after the date of this notice, and Commerce will finalize the lists five business days after that window. Petitioners and foreign governments that submitted an entry once will be automatically included in future annual lists unless they amend their entries.
