The Department of Commerce is asking for public feedback on a form used by nonprofits to request duty-free entry for scientific instruments. Duty-Free Entry Application Form

If you are a not-for-profit institution, a state or local government, or a federal agency importing a scientific instrument, you use Form ITA-338P to request duty-free entry under the Florence Agreement. The Department of Homeland Security uses the form to determine whether you meet the statutory eligibility requirements, and the Department of Commerce uses it to compare the imported instrument to similar instruments made in the United States.

Paperwork Burden and Cost

The agency estimates 90 respondents will each spend about 2 hours to complete Form ITA-338P, for an estimated total of 180 annual burden hours. The notice estimates the total annual cost to the public at $2,974.50 and states that responding is voluntary; comments on the collection are due by June 9, 2026.
