PFAS Reporting Start Date Delayed

If your company manufactured or imported PFAS for a commercial purpose since January 1, 2011, the period to submit required PFAS data will begin either 60 days after EPA publishes the effective date of a forthcoming final rule or on January 31, 2027—whichever comes earlier. This final rule establishing that start date is effective April 13, 2026.

Six-Month Submission Window Kept

For most reporters required to submit PFAS information, the submission period will last six months beginning on the applicable start date (January 31, 2027, or 60 days after the forthcoming final rule's effective date, whichever is earlier).

Extra Time for Small Article Importers

If you are a small manufacturer (as defined at 40 CFR 704.3) whose reporting obligations under this rule are exclusively for article import, your submission period will last twelve months starting on the applicable start date (January 31, 2027, or 60 days after the forthcoming final rule's effective date, whichever is earlier).

Who Must Report PFAS Data

This rule applies to any person who has manufactured (including imported) PFAS for a commercial purpose at any time since January 1, 2011. The preamble lists potentially affected sectors such as utilities (NAICS 22), manufacturing (NAICS 31-33), wholesale trade (NAICS 42), and waste management/remediation services (NAICS 562).

EPA Certifies Relief for Small Entities

EPA certifies under the Regulatory Flexibility Act that this action will not have a significant economic impact on a substantial number of small entities because it delays compliance dates and relieves regulatory burden on entities subject to the PFAS reporting rule.
