Patent applicants can instead seek fast-track status under the Fast-Track Appeals Pilot Program by filing a petition accompanied by a petition fee. That program sets a target of reaching a decision on the ex parte appeal within six months from the date the appeal is entered into the program.

Free COVID Fast-Track for Appeals Ends

The USPTO is terminating the Fast-Track for COVID-19-Related Appeals Pilot Program. Petitions filed after midnight ET on April 16, 2026 will not be granted, so you cannot obtain that COVID-specific free expedited review after that date.

Previously-Granted Fast-Track Status Preserved

If your ex parte appeal received fast-track status through a grantable petition filed by midnight ET on April 16, 2026, it will keep that fast-track status even if the appeal is still pending. Such appeals will retain fast-track status until PTAB jurisdiction ends under 37 CFR 41.35(b).
