Permittee Pays Removal Costs

If Enbridge does not comply, the President may direct an official or agency to remove the facilities at Enbridge's expense, and Enbridge cannot claim damages for that action.
Permittee Indemnifies United States
The permittee (Enbridge) must hold harmless and indemnify the United States from any claimed or adjudged liability arising from operation or maintenance of the Border facilities, including environmental contamination from release or discharge of hazardous substances or waste. This assigns legal liability for operational environmental claims to the permittee.
Government May Seize Facilities for Security
The President may enter and take possession of any of the Border facilities for national security reasons and retain control as long as necessary after giving due notice. If the United States exercises this right, it will pay the permittee just and fair compensation and bear the cost of restoring the facilities, less the reasonable value of any improvements made by the United States.
Subject to Pipeline Safety Inspections
The Border facilities (a 20-inch diameter pipeline extending about 15.5 miles from the international border in Pembina County, North Dakota) and their operation and maintenance are subject to inspections by federal, State, and local agencies and to all applicable laws and regulations, including Pipeline and Hazardous Materials Safety Administration rules. The permittee must grant free and unrestricted access for authorized officials and must obtain requisite State and local permits.
