No U.S. Sales Block for Redesigned Devices

On April 17, 2026, the U.S. International Trade Commission decided not to review an administrative law judge finding that the accused redesigned light-based physiological measurement products do not infringe the asserted patents. Because of that decision, those redesigned devices should not be excluded under the Commission's limited exclusion order, so businesses can continue selling and importing them in the United States without the exclusion order blocking sales.

Investigation Ended; Products Remain Available

The Commission terminated the investigation that began in August 2021 after the March 18, 2026 enforcement initial determination found no infringement and the Commission declined review on April 17, 2026. That termination means the accused redesigned devices will not be blocked from sale in the U.S., allowing consumers to continue buying those products without new restrictions stemming from this investigation.
