New administrative civil-penalty procedures (Subpart G)

FRA added Subpart G ( §§ 209.601–209.621 ) to implement administrative procedures for civil penalties: FRA begins a penalty proceeding with a demand letter; within sixty (60) days of service a respondent may (1) pay, (2) make an informal response (including a conference), or (3) request a hearing. Penalties are assessed per violation (each day a violation continues is a separate offense), individuals may be penalized only for willful violations, gross negligence or repeated violations can lead to aggravated maximum penalties, and a party has twenty (20) days to appeal a presiding officer's order.

Electronic service required for FRA filings

Starting May 26, 2026, the FRA requires that each order, notice, or other document that must be served under chapter II of subtitle B of title 49 of the CFR be served by an electronic method of delivery so long as there was no indication the transmission failed; U.S. mail may be used only if electronic service is impossible. The rule says the date of service is the date of electronic transmission and requires a certificate of service with each pleading.

Penalty payments moved to online system

As of May 26, 2026, payment of civil penalties to FRA must be made online at https://www.pay.gov/paygov/. The rule removes mailing and overnight delivery addresses and directs respondents to follow online payment instructions on that website.
