Commerce Opens AD/CVD Reviews
The Department of Commerce is initiating administrative reviews of specified antidumping (AD) and countervailing duty (CVD) orders effective May 4, 2026. The reviews cover the listed companies and periods (for example, periods such as 3/1/25–2/28/26 or 1/1/25–12/31/25) and Commerce intends to issue final results not later than March 31, 2027.
Separate Rate Certification Deadline
Companies in non‑market‑economy (NME) cases that want separate rate status must file a Separate Rate Certification (or Application if required) no later than 14 calendar days after this Federal Register notice was published. The certification form is available on Commerce's website on the publication date.
Separate Rate Application Rule
Firms that do not already have a separate rate from a completed segment or that have had corporate changes must file a Separate Rate Application no later than 14 calendar days after publication of this notice. The application must follow instructions available on Commerce's website.
Duty‑Absorption Inquiry Rights
If requested by a domestic interested party within 30 days of publication of this initiation notice, Commerce will determine whether antidumping duties have been absorbed by an exporter or producer when merchandise was sold in the U.S. through an affiliated importer. The request must name the exporter or producer for which the inquiry is requested.
Particular Market Situation Timing
Particular market situation (PMS) allegations under section 773(e) must be submitted no later than 20 days after submission of initial responses to section D of the questionnaire so Commerce has time to consider PMS claims when calculating constructed value.
Respondent Selection Timing Rules
If Commerce limits the number of respondents for individual examination, it intends to select respondents using CBP import data or quantity & value (Q&V) questionnaires; Commerce plans to place CBP data or the Q&V questionnaire on the record within five days of this notice and to make respondent selection decisions within 35 days of this Federal Register publication. Parties have seven days to comment on the data and five days to file rebuttals after the comment deadline.
Certification Eligibility Application Window
Exporters/producers not currently eligible to use the certification program (for shipments that may contain subject and non‑subject merchandise) must file a Certification Eligibility Application no later than 30 calendar days after this Federal Register notice. The application form was posted on Commerce's website.
Notice of No Sales Timing
If a producer or exporter named in an AD review had no exports, sales, or entries during the period of review (POR), it may notify Commerce of that fact within 30 days of publication of this initiation notice so Commerce can consider how to treat suspended entries under that company-specific case number.
Withdrawal Window for Review Requests
A party that requested an administrative review may withdraw that request within 90 days of publication of this notice (19 CFR 351.213(d)(1)); Commerce may extend that 90‑day period on a case‑by‑case basis if reasonable.
