CFPB Updates Employee Records Privacy Policy

Published Date: 5/20/2026

Notice

Summary

The Consumer Financial Protection Bureau is updating how it handles employee records by allowing certain personal info to be shared with the news and public under clear rules, similar to the Freedom of Information Act. This change affects current and former employees, volunteers, job applicants, and their families. Comments on this update are open until June 22, 2026, with no expected costs involved.

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

CFPB may disclose employee records publicly

If you are a current or former CFPB employee, volunteer, detailee, applicant, or person who works at the Bureau—or a named dependent, beneficiary, or emergency contact—the CFPB may disclose records about you to the news media and the public with the Bureau Director's approval starting June 22, 2026. The Bureau may do this only when there is a legitimate public interest (for example, to preserve confidence in CFPB integrity or to demonstrate accountability) and when the release would not be a clearly unwarranted invasion of personal privacy.

System holds sensitive identifiers and payroll data

The CFPB's Employee Administrative Records System includes sensitive personal and employment information such as Social Security numbers (SSNs), employee ID numbers, pay rate, salary, payroll data, benefits information, time and attendance records, and date of birth. Those categories of records are subject to the routine uses in the notice and therefore may be disclosed under the conditions described in the modified system of records.
