ITC Timing Could End or Continue Cases

The U.S. International Trade Commission (ITC) will preliminarily determine within 45 days after the Petitions were filed (the Petitions were filed April 30, 2026) whether imports from China, Malaysia, and/or Vietnam materially injure or threaten injury to a U.S. industry. A negative ITC determination for any country will terminate the investigation for that country.

CVD Investigations Launched for Air Compressors

The U.S. Department of Commerce initiated countervailing duty (CVD) investigations for stationary and portable air compressors from the People’s Republic of China, Malaysia, and the Socialist Republic of Vietnam, applicable May 20, 2026. The period of investigation (POI) is January 1, 2025 through December 31, 2025, and Commerce will make preliminary determinations no later than 65 days after this initiation unless postponed.

Exporters Must Respond to Q&V Questionnaires

Commerce will seek quantity-and-value (Q&V) responses from potential producers/exporters and intends to calculate company-specific subsidy rates. Responses to Q&V questionnaires must be submitted no later than 5:00 p.m. Eastern Time on June 3, 2026. For China Commerce will limit Q&V questionnaires to the largest producers/exporters with complete addresses; for Malaysia and Vietnam Commerce intends to issue Q&V questionnaires to each potential respondent with complete addresses.

Which Compressors Are Covered

The investigation covers certain stationary and portable reciprocating (piston) air compressors with integrated pressure vessels sized 1 to 80 gallons and power levels from 373 watts (0.5 HP) up to 22.37 kilowatts (30 HP). In-scope HTSUS subheadings include 8414.80.1615, 8414.80.1625, 8414.80.1635, and 8414.80.1685; rotary and dynamic compressors are excluded.

Deadline to Comment on Product Scope

Commerce set a deadline for interested parties to submit scope comments by 5:00 p.m. Eastern Time on June 9, 2026, and rebuttal comments by 5:00 p.m. ET on June 22, 2026. Commerce will consider those comments and may consult with parties before issuing preliminary determinations.
