Authorize Risk-Based Inspections

PHMSA proposes to allow operators to use risk-based inspection (RBI) procedures to set internal inspection intervals for in-service breakout tanks. The proposal limits the maximum initial internal inspection to 20 years and subsequent internal inspections to 25 years, and PHMSA estimates annual cost savings of $24.5 million to $125.7 million (3% discount) or $29.3 million to $150.1 million (7% discount).

Adopt API Std 653 (5th Edition)

PHMSA proposes to replace references to the 3rd edition of API Standard 653 with the 5th edition (November 2014) including addenda and errata through July 2025. PHMSA preliminarily finds the 5th edition improves safety and operational efficiency by adding requirements for door sheets, bearing plates, settlement analysis, and clearer hydrostatic testing rules that apply to repair, alteration, reconstruction, and inspections under Secs. 195.205, 195.307, and 195.432.

RBI Recordkeeping and Validation Rules

If operators use RBI under the proposed rule, they must retain records to reproduce the RBI analysis, including information for each required likelihood and consequence factor listed in API Std 653, and the RBI analysis must be validated and reviewed (PHMSA cites review at least once every 10 years or when changes warrant review). PHMSA also retains authority to inspect an operator's RBI analysis and take enforcement action if procedures are unreasonable.
