Continued Reporting Required Under ESA

NOAA is extending an existing information collection (OMB Control Number 0648-0399) that requires entities to submit plans and reports to limit application of ‘‘take’’ prohibitions under Section 4(d) of the Endangered Species Act. Comments are requested by August 3, 2026; the agency estimates 707 respondents with a combined annual burden of 167,872 hours and an estimated total annual cost to the public of $0 (examples: CA HGMP development 2,080 hours; CA FMEP development 1,230 hours).

Voluntary Plans Let You Avoid Take Ban

For 23 threatened west coast salmonid population segments in CA, OR, WA, and ID, NOAA may not apply section 9 'take' prohibitions to programs or activities it finds adequately protect listed salmonids. Entities that want to take advantage of those limits may voluntarily submit plans to NMFS and provide annual or occasional reports to continue within those limits.
