You must file a PMN/SNUN/MCAN first

If you plan to manufacture or import a new chemical substance for a non-exempt commercial purpose, TSCA section 5 requires you to submit a Premanufacture Notice (PMN), Microbial Commercial Activity Notice (MCAN), or Significant New Use Notice (SNUN) to EPA before starting the activity.

Test marketing exemption (TME) option exists

Under TSCA section 5(h)(1), you may apply for a test marketing exemption (TME) to manufacture or process a new chemical or a chemical subject to a Significant New Use Rule for test marketing if you show the activity will not present an unreasonable risk; EPA may allow manufacture under appropriate restrictions.

Microbial biotech follow 40 CFR part 725 rules

If you make or import new microbial products of biotechnology, premanufacture notification procedures are established in 40 CFR part 725. This includes MCANs and biotechnology exemptions (TERAs), TMEs for microorganisms, and Tier I and Tier II exemptions which you must follow.

You can submit comments on the new chemical submissions listed in this notice by July 6, 2026 through Regulations.gov using docket EPA-HQ-OPPT-2026-1387. Follow the online instructions and do not submit Confidential Business Information (CBI) via Regulations.gov.
