Investigation Expanded to New Patent Claims

The U.S. International Trade Commission allowed Align Technology to amend its complaint in Investigation No. 337-TA-1471 to add allegations of infringement for: claim 24 of U.S. Patent No. 11,766,313; claim 28 of U.S. Patent No. 11,766,314; claims 2 and 14 of U.S. Patent No. 8,866,977; and claim 9 of U.S. Patent No. 10,980,616. The investigation was instituted on December 29, 2025, Align moved to amend on April 14, 2026, and the Commission voted not to review the initial determination on June 3, 2026.

Respondents May Seek Time To Address New Claims

The Commission noted that nothing prevents the named respondents from petitioning the presiding administrative law judge to extend deadlines to accommodate the newly added dependent claims. The ID also noted respondents had notice to explore defenses before the close of fact discovery on May 7, 2026 and the close of expert discovery on June 15, 2026.
