Notice

Summary

Johnny Brand from Brand Partnerships wants permission to do farming at 3615 Foothill Road in Carpinteria, CA, even though it might accidentally harm some protected frogs and turtles. The Fish and Wildlife Service is reviewing his plan to protect these animals and wants your thoughts by July 13, 2026. This is a step to balance farming with saving wildlife without big delays or extra costs.

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Permit May Authorize Incidental Take

The Fish and Wildlife Service received an application for an incidental take permit (ITP) for activities at 3615 Foothill Road (APN 005-280-041) in Carpinteria, Santa Barbara County, CA. If issued, the ITP would authorize take of the federally threatened California red-legged frog (Rana draytonii) and the southwestern pond turtle (Actinemys pallida) incidental to otherwise lawful agricultural and restoration activities.

Restoration and 30-Year Mitigation Duties

The applicant's draft habitat conservation plan (HCP) would require restoring and managing 0.52 acres of riparian habitat and managing a detention basin to provide a perennial water source for the covered species during a 30-year permit term. The plan states habitat protection in the plan area is not permanent via a legal conservation easement, and the measures are intended to offset impacts while the permit term lasts.

Preliminary Low-Effect NEPA Finding

The Service preliminarily determined the proposed ITP would be a "low-effect" action and may qualify for a categorical exclusion under the National Environmental Policy Act and DOI regulations because it would individually and cumulatively have a minor effect on the covered species and the human environment. The Service prepared a low-effect screening form and is soliciting public review and comment.
