TSCA filing requirement before manufacture or import

Under TSCA section 5, any person who intends to manufacture (including import) a new chemical substance for a non-exempt commercial purpose, or to manufacture/process for a use EPA has designated a significant new use, is required to submit a PMN, MCAN, or SNUN to EPA before initiating that activity.

Public comment deadline: July 15, 2026

EPA is accepting public comments on the new-chemical submissions listed in this notice. Comments must be received on or before July 15, 2026, and should reference docket EPA-HQ-OPPT-2026-1387 and the specific case number.

EPA published March 2026 chemical lists

EPA published tables showing PMNs, SNUNs, MCANs, NOCs, and test information that passed initial screening during 2026-03-01 through 2026-03-31. Non-CBI information is available on the EPA website and in ChemView at https://chemview.epa.gov/ and via the TSCA review pages linked in the notice.

Test marketing exemptions (TME) under TSCA 5(h)(1)

TSCA section 5(h)(1) authorizes EPA to grant test marketing exemptions (TMEs) allowing manufacture or processing for test marketing under restrictions upon application and a showing that the activity will not present an unreasonable risk. The notice lists TME applications among covered submissions.
