Renewal of Worker Protection Data Collection

The EPA is renewing its information collection under the Worker Protection Standard (40 CFR part 170) to keep requiring agricultural employers and commercial pesticide handlers to provide training, notifications, postings, restricted entry interval (REI) information, access to pesticide information, and related recordkeeping. The collection is mandatory under 40 CFR 170 and the current approval runs through June 30, 2026; EPA is accepting comments on the renewal until July 22, 2026.

The ICR estimates 10,840,082 respondents (agricultural employers and commercial pesticide handling establishments) and a total annual respondent burden of 10,137,696 hours, with a total estimated cost of $446,339,743 per year. These figures represent the annual paperwork and recordkeeping cost the EPA attributes to compliance with the Worker Protection Standard information requirements.

Renewal Adjusts Burden Slightly Downward

EPA states there is a decrease of 50,974 hours in the total estimated respondent burden compared with the currently approved ICR; EPA says the activities and per-response burdens stayed the same and the decrease is due to adjustments to the estimated number of respondents. EPA also states there are no new capital or operation & maintenance costs included in the total estimated cost.
