Premanufacture Notice Requirement

Under TSCA section 5, any person who intends to manufacture (including import) a new chemical substance for a non-exempt commercial purpose must provide EPA with a Premanufacture Notice (PMN), Microbial Commercial Activity Notice (MCAN), or Significant New Use Notice (SNUN) before starting the activity. EPA will review the notice and make a risk determination under TSCA section 5(a)(3).

Test Marketing Exemption Option

TSCA section 5(h)(1) authorizes EPA to grant Test Marketing Exemptions (TMEs) that allow limited manufacture or processing for test marketing purposes under restrictions if the activity will not present an unreasonable risk to health or the environment. Interested parties may apply for a TME under the procedures described in TSCA and related EPA regulations.

Deadline to Comment on New Chemicals

The EPA is accepting public comments on new-chemical submissions and related status information; comments must be received on or before July 23, 2026. Submit comments online at https://www.regulations.gov under docket EPA-HQ-OPPT-2026-1387 and include the specific case number for the chemical you are commenting on.

EPA is providing tables and periodic status reports on TSCA section 5 submissions (PMNs, SNUNs, MCANs, TMEs, NOCs, and test information) and posts non-CBI information online.
