Eminent domain risk for landowners

If you own land in Dearborn County, Indiana; Boone County, Kentucky; or Hamilton County, Ohio, Texas Gas may contact you to request an easement to build the pipeline. You are not required to agree, but if the Commission approves the project the Natural Gas Act conveys the right of eminent domain to the company so it could initiate condemnation proceedings; compensation would be determined by a judge under state law.

Permanent loss of 76 acres

Construction of the project would disturb about 199.0 acres of land and Texas Gas would maintain about 76.0 acres for permanent operation of the pipeline; the remaining acreage would be restored and revert to former uses. If your property is in the project area in Dearborn County, Indiana; Boone County, Kentucky; or Hamilton County, Ohio, part of your land could be used permanently for pipeline facilities.
