Possession Becomes a Schedule I Offense

If you possess mitragynine pseudoindoxyl, MGM-15, or MGM-16 after the temporary order is published, you will be subject to Schedule I rules and the CSA's civil and criminal penalties. The temporary order will take effect on the date it is published in the Federal Register (to be published on or after August 5, 2026) and impose schedule I controls.

Researchers Face Schedule I Requirements

If you conduct research, instructional activities, or chemical analysis with mitragynine pseudoindoxyl, MGM-15, or MGM-16, those activities will be subject to Schedule I regulatory controls and associated administrative requirements and sanctions once the temporary order is published. The temporary order will take effect on its publication date (on or after August 5, 2026).

Retailers and Vendors Lose Legal Market Access

Retailers, online vendors, vape shops, gas stations, and other sellers of products containing these chemicals will be subject to Schedule I prohibitions on manufacture and distribution when the temporary order is published. Selling or distributing these substances will trigger the CSA's criminal and civil sanctions.

Temporary Scheduling Period Set (2 + 1 Years)

The temporary placement of mitragynine pseudoindoxyl, MGM-15, and MGM-16 in Schedule I will remain in effect for two years from the order's publication date, with a possible one-year extension if regular scheduling proceedings are initiated. The DEA intends to publish the temporary scheduling order on or after August 5, 2026.
