Certain products of Canada listed in Annex II will be subject to an additional ad valorem duty of 50 percent for goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern time on August 19, 2026.
Measure Intended to Aid U.S. Producers
The proclamation states the additional duties are intended to offset Canada's bans on U.S. alcoholic beverages and to expand opportunities for U.S. producers, revitalizing U.S. production and supporting U.S. workers; the duties (50 percent) take effect August 19, 2026.
Foreign-Trade Zone Admission Rule Change
Any product subject to these duties that is admitted into a U.S. foreign-trade zone on or after the effective date must be admitted as "privileged foreign status," and such merchandise will be subject upon entry for consumption to any ad valorem rate of duty related to its HTSUS classification; effective for entries on or after 12:01 a.m. eastern time on August 19, 2026.
Carve-Outs: Section 232 and Civil Aircraft
The proclamation states the additional duties do not apply to articles subject to duties pursuant to section 232 of the Trade Expansion Act of 1962 or to articles (excluding unmanned aircraft) subject to the World Trade Organization Agreement on Trade in Civil Aircraft.
