Commerce Authorized To Act Under DPA

The Secretary of Commerce is authorized and directed to implement this determination under section 101 of the Defense Production Act of 1950. The Secretary may issue regulations, rules, guidance, and procedures and must publish this determination in the Federal Register.

Recoverable CMMs: What’s Included

The President's determination says the phrase "recoverable critical minerals and materials" includes black mass, end-of-life rare-earth permanent magnets or other fully manufactured end-of-life goods, swarf, and other waste and scrap that contain critical minerals and materials. The determination also says copper scrap is not included because it is already covered under Proclamation 10962 of July 30, 2025.
