Johnson Health Tech must pay a civil penalty of $16,875,000 within 30 calendar days after receiving service of the Commission's final Order accepting the settlement. If Johnson Health Tech does not pay on time, interest accrues at the federal legal rate under 28 U.S.C. 1961 and the United States may pursue collection actions.

Recall: ~192,000 Horizon T101-05 Treadmills

Johnson Health Tech and the CPSC jointly announced a recall of about 192,000 Horizon T101-05 treadmills on October 27, 2022. The recall offered a software update to address unexpected accelerations, stoppages, or speed changes that could create a fall hazard; the treadmills were imported and distributed in the U.S. between 2018 and 2022.

Company Must Adopt CPSA Compliance Program and Reporting

Johnson Health Tech must adopt and maintain a written Consumer Product Safety Act (CPSA) compliance program with specific elements (policies, claim tracking, timely reporting, employee training, confidential reporting, appointment of a product safety professional, internal audits). The company must retain compliance records for at least five (5) years and submit annual sworn reports for three (3) years, with the first report due 30 days after the close of the first 12-month reporting period beginning on the date of the Commission's Final Order.
