Uncle Sam Slaps Duties on Chinese Aluminum Foil Pans!

Summary
In response to a request from the Aluminum Foil Containers Manufacturers Association (AFCMA) and the following individual members of AFCMA, Durable Packaging International; D&W Fine Pack, LLC; Handifoil Corp.; Penny Plate, LLC; Reynolds Consumer Products, LLC; Shah Foil Products, Inc.; Smart USA, Inc.; Trinidad/Benham Corp.; and Wyda Packaging Corp. (collectively, the requesters), the U.S. Department of Commerce (Commerce) is initiating country-wide circumvention inquiries to determine whether imports of disposable aluminum containers, pans, trays, and lids (aluminum containers) completed in Indonesia and Malaysia (collectively, the third countries) using aluminum foil manufactured in the People's Republic of China (China), are circumventing the antidumping duty (AD) and countervailing duty (CVD) orders on aluminum containers from China.

Suspension of liquidation, cash deposits directed
Commerce will notify U.S. Customs and Border Protection (CBP) to continue suspension of liquidation for entries already suspended under the Orders and to apply the cash deposit rates that would apply if the products are determined to be covered by the Orders. Commerce may also instruct CBP to begin suspension of liquidation and application of cash deposits for unliquidated entries entered or withdrawn for consumption on or after the publication date (August 6, 2026), and may apply those measures to certain unliquidated entries prior to initiation but not for entries dated before November 4, 2021.
Country-wide circumvention inquiries started
The U.S. Department of Commerce has started country-wide circumvention inquiries to determine whether disposable aluminum containers completed in Indonesia and Malaysia using aluminum foil manufactured in the People’s Republic of China are circumventing existing antidumping and countervailing duty orders on such products from China. The inquiries cover imports of those containers exported from Indonesia and Malaysia to the United States and were initiated effective August 6, 2026.
150/300‑day decision timetable announced
Commerce intends to issue preliminary circumvention determinations no later than 150 days from the publication of the initiation notice (150 days from August 6, 2026) and final determinations no later than 300 days from publication (300 days from August 6, 2026), unless the inquiries are rescinded or extended. Businesses importing or exporting the covered products should plan for these timelines.

The U.S. Department of Commerce has officially ended the countervailing duty on carbazole violet pigment 23 imported from India because no one in the U.S. spoke up to keep it. Starting August 7, 2026, imports of this pigment from India won’t have extra taxes, which could shake up prices and trade. 2026-16003, Certain Softwood Lumber Products From Canada: Notice of Amended Final Results of Countervailing Duty Expedited Review; Notice of Reinstatement of Countervailing Duty Order
On July 21, 2026, the U.S. Court of International Trade (CIT) issued its final judgment in Committee Overseeing Action for Lumber International Trade Investigations or Negotiations, et al. v. United States, et al., Consol. Court No. 19-00122 (Slip Op. 26-77) (CIT 2026) sustaining the U.S. Department of Commerce's (Commerce) final results of remand redetermination (remand redetermination), concerning the countervailing duty (CVD) order on certain softwood lumber products (softwood lumber) from Canada. In particular, the CIT sustained Commerce's remand redetermination calculating a 1.05 percent ad valorem subsidy rate for Les Produits Forestiers D&G Lt[eacute]e (D&G) and its cross-owned company Les Produits Forestiers Portbec Lt[eacute]e (Portbec). Because D&G/Portbec's rate is now above de minimis, subject merchandise produced and exported by D&G/Portbec is included within the CVD order on softwood lumber from Canada.
