Summary

Notice is hereby given that on August 7, 2026, the presiding administrative law judge ("ALJ") issued an Initial Determination on Violation of Section 337. The ALJ also issued a Recommended Determination on remedy and bonding should a violation be found in the above-captioned investigation. The Commission is soliciting submissions on public interest issues raised by the recommended relief should the Commission find a violation. This notice is soliciting comments from the public and interested government agencies only.

Possible Exclusion Order Targeting PVDF Resins

The ALJ recommended that, if a violation of Section 337 is found, the Commission consider a limited exclusion order directed to certain polyvinylidene fluoride (PVDF) resins imported, sold for importation, and/or sold after importation by respondents Zhejiang Fluorine Chemical New Material Co. Ltd.; Hubei Fluorine New Materials Co., Ltd.; Sinochem Lantian Co., Ltd.; and Zhejiang Juhua Co., Ltd. The Commission will consider public-interest effects on public health and welfare, U.S. competitive conditions, U.S. production of like articles, and U.S. consumers before deciding whether to exclude these articles from entry.

Public Comment Window Open to Sept 10, 2026

The U.S. International Trade Commission is asking members of the public and government agencies to file written comments about the recommended remedy by close of business on September 10, 2026. Submissions must be no more than five (5) pages (including attachments) and the original must be filed electronically pursuant to 19 CFR 210.4(f).
