The Criminal Division, Department of Justice (DOJ), will be submitting the following information collection request to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act of 1995.

DOJ certification needed for early LPR

If you are a T visa holder who wants to apply for adjustment to Lawful Permanent Resident status within 3 years of receiving your T visa, you must submit a document signed by the Attorney General (or designee) attesting the investigation or prosecution is complete. The DOJ is creating a new information collection (Form 1123-1NEW) to process requests for these DOJ certification letters and estimates an average of 3 hours per applicant, assuming about 2,000 applications annually (6,000 annual burden hours). T visas otherwise allow qualifying victims to remain in the U.S. for up to 4 years.

Minors/traumatized exempt from cooperation

Minors and victims who are too traumatized to assist law enforcement are exempt from the law-enforcement-cooperation requirement for T visa eligibility under 8 U.S.C. 1101(a)(15)(T)(i)(III). That means children or similarly affected victims do not have to provide assistance to qualify for T visas.
