Waiver Process for Mine Sanitary Rules

If you operate a coal mine, you may apply for a waiver when you cannot meet the surface sanitary facilities rules (see 30 CFR 71.400–71.404 and 75.1712-1–75.1712-5). Applications must be filed with the District Manager where the mine is located and include the operator name and address, the mine name and location, and a detailed statement of the grounds for the waiver.

Paperwork and Cost Burden for Waivers

The Mine Safety & Health Administration estimates this information collection will involve 204 respondents and 612 responses, with a total estimated annual time burden of 86 hours and total annual other costs of $1,020 under OMB Control Number 1219-0024. The Department asks OMB to approve the collection for three (3) years and will accept public comments through September 18, 2026.
