DHS Clarifies Genealogy Rules Amid Federal Records Maze

Published Date: 8/21/2026

Proposed Rule

Summary

The U.S. Department of Homeland Security (DHS) proposes to amend its regulation governing genealogy program related records requests to revise its genealogy program regulations to clarify the impact of statutory and regulatory federal records requirements. This is necessary for individuals who request immigration records through the agency's genealogy program to better understand which records may be requested.

Analyzed Economic Effects

3 provisions identified: 0 benefits, 3 costs, 0 mixed.

Historical records moved to NARA

USCIS will only produce historical immigration records that have NOT been transferred to the National Archives and Records Administration (NARA). When USCIS transfers legal custody of historical records to NARA, USCIS will post a notice on the USCIS Genealogy website and requestors must obtain those records directly from NARA.

Fees and work shift from USCIS to NARA

USCIS expects work and the collection of genealogy request fees to move from USCIS to NARA as records are transferred. USCIS currently charges $80 for paper filing and $30 for online filing for each Form G-1041 and G-1041A, and DHS estimates a 5-year annual average of 8,953 Form G-1041 index searches and 5,790 Form G-1041A records requests.

AR-2 Requests already moved to NARA

USCIS no longer processes Alien Registration Form (AR-2) requests received on or after May 17, 2024; AR-2 records from August 1, 1940 to March 31, 1944 are available through NARA.
