Permit Gives Priority to File License

Landowner Entry and Activity Protection
A preliminary permit does not let the applicant enter or disturb land or water that someone else owns without that owner’s express permission. The permit only gives priority to apply for a license and does not authorize land-disturbing activities.

The public can file comments, motions to intervene, notices of intent, or competing applications by 5:00 p.m. Eastern Time on October 20, 2026. The Commission encourages electronic filing and allows brief eComments up to 10,000 characters without registration.
