SBA Updates Loan Records for Treasury Payment Checks

Summary
In accordance with the Privacy Act of 1974, as amended, the U.S. Small Business Administration (SBA, "the Agency") proposes modifying the existing system of records identified as Loan System, SBA 21 to allow information in the system to be disclosed to the Department of the Treasury for purposes of identifying, preventing, or recouping improper payments through Treasury's Do Not Pay Working System. Additional changes are proposed to comply with Office of Management and Budget (OMB) Circular A-108 and reflect technical updates to the system. This system of records is used to determine eligibility and conduct financial transactions and reporting related to business loans, grants, and surety bonds.

SBA Data Shared with Treasury Do Not Pay
If you apply for or receive an SBA loan, grant, or surety bond, SBA may disclose your loan and identity records (for example: name, Social Security number, date of birth, address, loan number, and loan information) to the U.S. Department of the Treasury’s Do Not Pay Working System to identify, prevent, or recoup improper payments. This routine use is part of SBA’s modified Loan System (SBA21) and the new or modified routine uses are effective October 5, 2026.
Delinquent Debt Shared with CAIVRS
SBA may provide delinquent debt information (including names of businesses and individuals) to the Department of Housing and Urban Development or other federal CAIVRS participants for publication so participating agencies and approved private lenders can search it. This enables publication of debts delinquent to or guaranteed by SBA and is included in SBA21’s routine uses (effective October 5, 2026 for new or modified routine uses).
Approved Loan Details Published Publicly
SBA may disclose information about approved loans to the public, including recipient name and address, the term and rate of the loan, and the amount paid in full or charged off. This change to the Loan System (SBA21) is part of the modified routine uses and the new or modified routine uses are effective October 5, 2026.

2026-17987, Updated Minimum Performance Standards for Commercialization for Firms That Receive Funding Through the Small Business Innovation Research (SBIR) and Small Business Technology Transfer (STTR) Programs
The U.S. Small Business Administration (SBA) is publishing for public comment updated minimum performance standards for commercialization for firms funded through the Small Business Innovation Research (SBIR) and Small Business Technology Transfer (STTR) Programs. This commercialization benchmark establishes a minimum share of annual revenue that a Small Business Concern (SBC) must derive from sources other than SBIR or STTR program funding in order to remain eligible for a new Phase I or Direct-to-Phase II award, where that SBC has received more than 25 Phase II awards during the five most recently completed fiscal years, excluding the current fiscal year. The revised benchmark will supersede the benchmark announced at 78 FR 48537 and 78 FR 59410. This requirement is issued under the authority of Section 9 of the Small Business Act.

This final rule rescinds the Administration's policy of engaging in notice and comment rulemaking even where the Administrative Procedure Act does not require notice and comment rulemaking. As a result of this final rule, the Administration will follow the default requirements of the Administrative Procedure Act. The Administration will reserve the right to engage in voluntary notice and comment rulemaking even where not required by the Administrative Procedure Act as a matter of policy on a case by case basis.

The Secretary of Health and Human Services (HHS) is issuing this notice pursuant to section 564 of the Federal Food, Drug, and Cosmetic (FD&C) Act. On July 15, 2026, the Secretary of War determined under the FD&C that there is a military emergency, or a significant potential for a military emergency, involving a heightened risk to U.S. military forces of an attack with a chemical, biological, radiological, or nuclear agent or agents; or an attack by an agent or agents that may cause, or are otherwise associated with an imminently life-threatening and specific risk to those forces. Injuries arising from these attacks may cause those forces to experience moderate to severe acute pain and place them at risk of developing life-threatening hemodynamic instability, including shock or respiratory distress. On the basis of this determination, the Secretary of HHS declared on August 31, 2026, pursuant to the FD&C Act, that circumstances exist justifying the authorization of emergency use of drugs identified and supported by the Department of War (DOW) as addressing an unmet military operations- related medical need for use to manage moderate to severe acute pain in casualties caused by, or associated with, an emergency involving biological, chemical, radiological, or nuclear agent or agents, or agents of military combat, including firearms, projectiles, and explosive devices, that may cause, or may otherwise be associated with, an imminently life-threatening and specific risk to U.S. military forces, subject to the terms of any authorization issued under that section.
