DC: No Other Solid Waste Incinerators
The District of Columbia submitted a negative declaration on May 21, 2026 certifying there are no existing "other solid waste incinerators" (OSWI) subject to Clean Air Act sections 111(d) and 129 in DC. EPA is proposing to approve that declaration, so no OSWI pollution-control rules or compliance costs will be imposed in DC under 40 CFR part 60 subpart FFFF. EPA is accepting public comments on this proposal through October 14, 2026.

EPA certified this proposed approval does not have a significant economic impact on a substantial number of small entities under the Regulatory Flexibility Act (5 U.S.C. 601 et seq.). 2026-18317, Updated Definition of “Waters of the United States”
The purpose of this supplemental notice of proposed rulemaking is for the U.S. Environmental Protection Agency (EPA) and the Department of the Army ("the agencies") to supplement and seek additional comment on certain aspects of an earlier proposal, published on November 20, 2025, to revise the regulations defining the scope of waters federally covered under the Clean Water Act in light of the U.S. Supreme Court's 2023 decision in Sackett v. Environmental Protection Agency. As stated in the agencies' November 20, 2025 Notice of Proposed Rulemaking (NPRM), the agencies intend for this rulemaking to provide greater regulatory certainty and increase Clean Water Act program predictability and consistency by clarifying the definition of "waters of the United States." After consideration of the public comments received on the NPRM, the agencies are issuing this notice to supplement the NPRM with additional regulatory options on certain aspects of the proposed rule.

The EPA is giving U.S. Ecology Nevada a special green light to handle and dispose of high-mercury waste a bit differently than usual. This means mercury waste treated in Pennsylvania can now be safely sent to U.S. Ecology’s Nevada site for disposal under new rules starting July 27, 2026. This change helps protect people and the environment while keeping mercury waste management efficient and cost-effective.

The EPA just updated rules for places that burn hazardous waste, like incinerators and boilers, to keep the air safe and clean. The U.S. Environmental Protection Agency (EPA or "Agency") is proposing to issue a clean data determination (CDD) for the Sacramento Metro, California nonattainment area to reflect our finding that the area is attaining the 1997 8-hour ozone national ambient air quality standards (NAAQS or "standards"). This finding is based on quality-assured and certified ambient air quality monitoring data from 2023 through 2025. If we finalize this CDD, certain Clean Air Act (CAA) requirements that apply to the Sacramento Metro area will be suspended for so long as the area continues to attain the 1997 8-hour ozone NAAQS. We are taking comments on this proposal and plan to follow with a final action.

The FAA proposes to supersede Airworthiness Directive (AD) 2024-26-06, which applies to certain Airbus SAS Model A330-201, -202, - 203, -223, -223F, -243, -243F, -301, -302, -303, -321, -322, -323, - 341, -342, -343, and -941 airplanes; and all Airbus SAS Model A340-211, -212, -213, -311, -312, and -313 airplanes. AD 2024-26-06 requires modifying the trimmable horizontal stabilizer actuator (THSA) installation, implementing the electrical load sensing device (ELSD) wiring provisions, and installing and activating the ELSD with revised procedures and also requires additional actions for certain airplanes. Since the FAA issued AD 2024-26-06, it has been determined that additional actions are required on certain airplanes after completion of the modification. This proposed AD would continue to require the actions in AD 2024-26-06 and would require additional work for certain airplanes. The FAA is proposing this AD to address the unsafe condition on these products.
