Brokers Dodge Fingerprints? SEC Extends Exemption Forms

Published Date: 9/25/2026

Notice

Summary

The SEC is asking to extend the paperwork rules for fingerprint exemptions under Rule 17f-2(e). This affects brokers, dealers, and other financial pros who need to keep and share special exemption notices about fingerprinting. No big changes or costs are expected, but they must keep these records handy and up to date to keep things smooth and secure.

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

Fingerprint-exemption notice must be kept onsite

If you are a covered entity (every member of a national securities exchange, broker, dealer, registered transfer agent, or registered clearing agency), you must prepare and keep current a statement titled "Notice Pursuant to Rule 17f-2" containing the information in Rule 17f-2(e)(1) to claim a fingerprinting exemption. You must keep a copy of that Notice at the organization's principal office and at the office employing the exempt persons, make it available for inspection by the SEC or other designated examining authority, and retain it according to applicable retention rules (for example, registered clearing agencies must keep at least one copy for not less than five years under Rule 240.17a-1; certain brokers and dealers must maintain it for the life of the enterprise under Rule 240.17a-4; transfer agents under Rule 240.17Ad-7 must keep it in an easily accessible place).

Estimated annual paperwork time: 0.5 hour

The SEC estimates about 75 covered entities will spend an average of 0.5 hours per year each to comply with Rule 17f-2(e): 0.4 hours for documenting the exemption (reporting) and 0.1 hours for retention (recordkeeping). The aggregate annual burden across all entities is estimated at approximately 38 hours.
