Summary

NYSE National is updating its rules for Equity Trading Permit (ETP) holders to match recent changes made by FINRA. The change keeps things fair and clear for everyone trading on the exchange.

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Shorter Exam Retake Waiting Periods

The rule shortens waiting times to retake securities qualification exams. The waiting period after the first and second failed attempts is reduced from 30 calendar days to 15 calendar days, and the waiting period after the third and all subsequent failed attempts within a two-year period is reduced from 180 calendar days to 60 calendar days; this applies to the Securities Industry Essentials (SIE) exam and the representative and principal exams under NYSE National Rule 2.1220. The Exchange will announce the implementation date via a Regulatory Memo on or around the same time as FINRA's Regulatory Notice.

No New Costs; Faster Hiring Decisions

The Exchange states the amendment conforms its retake waiting periods to FINRA's and does not impose any new obligations or restrictions on Equity Trading Permit (ETP) Holders. The Exchange says this alignment may benefit ETP Holders by allowing them to more quickly make personnel decisions regarding associated persons' qualification exam retake timing, with no new costs imposed.
