Carriers No Longer Must Verify Delivery Recipients
Common and contract carriers delivering explosive materials are no longer required to verify the identity of the person accepting delivery on behalf of the distributee and the final rule rescinds ATF Ruling 2003-5. This change takes effect October 26, 2026.
Relief-from-Disability Application Timing for Aliens
The rule clarifies that aliens (non-U.S. residents) may begin the ATF relief-from-disability application process before entering the United States, but the relief cannot be granted until the alien has been lawfully admitted. The regulation also states relief for aliens remains effective only so long as they retain lawful immigration status, and applicants should expect ATF processing timelines (applicants are told to expect up to 120 days).
Report New and Removed Responsible People
If you hold a federal explosives license or permit, you must report each new and each removed Responsible Person (RP) to the Chief, Federal Explosives Licensing Center within 30 days of the change. You must also report each new and each removed employee authorized to possess explosives within 30 days; new RPs and employees may possess explosives as part of their job when hired so long as the required form is submitted and until the Chief, FELC, notifies otherwise.
ATF eZ-Check System Available for Explosives Licenses
ATF has made an eZ-Check system available on its website for federal explosives licensees/permittees to verify another party's explosives license/permit status; the final rule does not mandate use of the system. ATF states the eZ-Check system has been available since 2017.
