Must get written clearing agreement before Night Session trades

If you are a Nasdaq Member who wants to trade in the Night Session (9:00 p.m. through 4:00 a.m., Sunday through Thursday) using another Member as your clearing firm, the designated Clearing Member must first affirm in writing that it will assume responsibility for clearing and settling all trades you execute in the Night Session. The written affirmation may be a letter of authorization, letter of guarantee, letter of consent, or any other agreement acceptable to the Exchange, and the Exchange proposes to implement this requirement as soon as practicable during September 2026 ahead of planned Night Session start in or about December 2026.

Clearing firms gain formal control over Night Session correspondents

If you are a clearing member firm, the rule gives you a formal mechanism to confirm which correspondent Members you will clear for during the Night Session by requiring your written affirmation that you will assume clearing and settlement responsibility for those correspondents' Night Session trades. Nasdaq says clearing firms requested this mechanism to manage operational, risk-management, and supervisory considerations for overnight trading.
