FERC Snoozes Through Form Extension Without a Hitch

Published Date: 10/6/2026

Notice

Summary

FERC is renewing its info collection form called FERC-603, which helps protect important energy infrastructure details. No changes are planned, but folks who submit this info should know the deadline to comment is November 5, 2026. This keeps the process smooth without adding extra costs or paperwork.

Analyzed Economic Effects

5 provisions identified: 2 benefits, 3 costs, 0 mixed.

CEII Process Provides FOIA Alternative

The FERC-603 CEII process is an alternative route to obtain sensitive energy infrastructure information instead of using the Freedom of Information Act (FOIA), which often leads to withholding under FOIA Exemptions 3 or 7. This can help market participants with a legitimate need obtain information while protecting sensitive details.

FERC-603 Extended for Three Years

FERC is renewing the FERC-603 information collection for a three-year extension with no changes to the reporting or recordkeeping requirements. This keeps the current process and forms in place for anyone who requests Critical Energy/Electric Infrastructure Information (CEII).

Small Time and Cost to Submit CEII Request

If you submit a CEII request, FERC estimates each response takes 0.3 hours and costs about $30.60 per response. The estimate for all respondents is 100 responses totaling 30 hours and $3,060 per year.

Required Information and NDA Terms to Get CEII

To get CEII you must provide your name, title, contact information, the name of the entity on whose behalf you request the information, a detailed statement of need, and an executed non-disclosure agreement. The non-disclosure agreement limits use to the stated purpose, restricts discussion to authorized recipients, prohibits disclosure outside the United States, requires secure handling and destruction or return on request, and makes the information not subject to FOIA or Sunshine Laws.

CEII Designation Duration and Ongoing Obligations

A CEII designation may last for up to five years unless re-designated, and recipients must continue to protect the CEII even after a designation lapses until the CEII Coordinator determines it should no longer be designated. The Commission may audit compliance and requires prompt reporting of any unauthorized disclosures.
