India's Chromium Trioxide Gets U.S. Countervailing Duties

29.35% Countervailing Duty on Imports

If you import chromium trioxide from India, Commerce found countervailable subsidies and assigned an estimated countervailable subsidy rate of 29.35 percent ad valorem to Vishnu Chemicals Limited and to all other Indian producers/exporters for the period January 1, 2024 through December 31, 2024. This determination is applicable October 8, 2026.

Suspension of Liquidation and Cash Deposits Dates

U.S. Customs and Border Protection was instructed to collect cash deposits and suspend liquidation for entries of subject chromium trioxide produced/exported by Vishnu Chemicals Limited and all other producers/exporters entered or withdrawn for consumption on or after May 14, 2026. Commerce instructed CBP to discontinue suspension of liquidation for entries on or after September 11, 2026, but to continue suspension for entries subject to suspension between May 14, 2026 and September 10, 2026. If the U.S. International Trade Commission (ITC) makes a final affirmative injury finding, Commerce will reinstate suspension and require cash deposits in the amounts indicated above.

Which Chromium Trioxide Imports Are Covered

The scope covers chromium trioxide (CAS 1333-82-0) in any form (dry or solution), including blends that contain 90 percent or more chromium trioxide by total formula weight, processed forms (e.g., solution produced in a third country), and related CAS numbers; the HTSUS subheading cited is 2819.10.0000.

ITC Injury Decision Within 45 Days

The U.S. International Trade Commission (ITC) will make its final determination as to whether the U.S. industry is materially injured by imports of chromium trioxide from India no later than 45 days after this final determination. If the ITC finds injury, Commerce will issue a countervailing duty order and require cash deposits; if the ITC finds no injury, the proceeding will be terminated and any deposited estimated duties will be refunded or canceled.
