Credit Unions Ditch Legal Nods for Wild New Powers
Published Date: 10/15/2026
Proposed Rule
Summary
Federal credit unions (FCUs) won’t have to ask for a legal thumbs-up before trying new activities outside their usual powers. This change makes it easier and faster for FCUs to grow and serve members without extra red tape. Comments on this proposal are open until December 14, 2026, so speak up if you want to weigh in!
Analyzed Economic Effects
2 provisions identified: 2 benefits, 0 costs, 0 mixed.
No mandatory legal opinion before petitions
If you are a federal credit union (FCU), you are not required to obtain an advisory legal opinion from the NCUA's Office of General Counsel before petitioning the NCUA Board to engage in an activity that is not already a preapproved incidental power. The proposal removes the sentence in §721.4(a) and related language in §721.1 clarifying that seeking such an opinion is optional.
No significant impact on small credit unions
The NCUA certifies that this proposed amendment would not have a significant economic impact on a substantial number of small credit unions. For purposes of the analysis, the NCUA defines small credit unions as those with under $100 million in assets.
