Nasdaq PHLX Changes When Traders Receive Product Descriptions

Published Date: 11/5/2026

Notice

Summary

Nasdaq PHLX is updating its rules about sharing info on certain traded products. They’re dropping the old rule that required sending info before trading starts and instead will provide approved descriptions when buyers get their first trade confirmation. This change affects members trading these products and kicks in right away, with no extra costs involved.

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Remove Pre‑Trade Exchange Circular Requirement

The Exchange deleted the rule that required it to distribute an information circular to Members prior to the commencement of trading in each UTP Exchange Traded Product. The Exchange says Members can rely on the primary listing exchange's information circular, which Members generally have access to before UTP trading begins.

Product Description May Be Delivered With First Trade

Where a written description is required by the listing exchange, the Exchange now requires that description to be provided in a form approved by the listing exchange or prepared by the open‑ended management company not later than the time a confirmation of the first transaction in that series is delivered to the purchaser. The Exchange will notify Members by information circular that this written description requirement applies only when mandated by the listing exchange.

Make Suitability and Disclosure Rules Explicit

The Exchange added express cross‑references in Equity 8A, Section 5(a)(1) to General 9, Section 10 (Recommendations to Customers (Suitability)) and Equity 2, Section 20 (Customer Disclosures) to highlight that those Member obligations apply in the context of UTP Exchange Traded Products. The filing states these rules already apply to Members and the cross‑references simply make the framework explicit.
