Summary
Protects local control over data-center siting on non-Federal land. This bill would bar any head of a federal agency from overriding, bypassing, or displacing state or local land-use, zoning, siting, or permitting authority for data centers on non-Federal land. It would also prohibit conditioning receipt of federal funds on a state or local government relinquishing or limiting that authority. The policy would apply across all federal agencies and to all data centers on non-Federal land.

Protect local control over data centers
This bill would stop the head of any Federal agency from overriding, bypassing, or displacing state or local land-use, zoning, siting, or permitting authority for data centers on non-Federal land. It would also bar federal agencies from making federal funds conditional on a state or local government giving up that authority. If enacted, the rule would operate notwithstanding other laws and would take effect upon enactment. Local governments and nearby communities would keep current control over where data centers can be built, and developers would remain subject to local rules.
