  • Businesses and messaging services would need to include the disclosure and follow new definitions for robocalls and text messages, covering automatic dialing systems and common message types like SMS, MMS, and RCS.
  • Regulators would be able to double existing forfeiture and criminal fine caps when AI is used to impersonate someone with intent to defraud or cause harm, and those enhanced penalties would apply to violations after enactment.

New rules for AI robocalls and texts

This bill would require robocalls and texts that use AI to sound like a person to say at the start that AI is being used. It would define what counts as a robocall or text, including SMS, MMS, and RCS. Calls or texts that need substantial human intervention would not count, and the text definition would exclude real-time two-way voice or video. If someone uses AI to impersonate a person or company to defraud, cause harm, or get something of value, the maximum civil and criminal fines could be doubled. The disclosure rules would start upon enactment, and the higher penalties would apply to violations after enactment.
