Thirty-Two Hour Workweek Act

Sponsored By: Representative Takano, Mark [D-CA-39]

Introduced

Summary

A 32-hour workweek becomes the new federal overtime baseline. The bill rewrites the Fair Labor Standards Act so hours over 32 per week trigger overtime pay and it adds daily overtime rules that pay 1.5x after 8 hours and double pay after 12 hours, with a three-year phase-in of weekly thresholds.

New overtime pay and protections for workers

If enacted, workers would get overtime pay for hours over 32 in a workweek under the new standard. Daily overtime would pay 1.5 times for hours over 8 up to 12, and double pay for hours over 12. The 32-hour threshold would phase in starting not less than 180 days after enactment: year 1 overtime over 38 hours, year 2 over 36, year 3 over 34, then over 32 after year 3. Employers could not cut your hourly rate, weekly pay, or other benefits because you become covered by the new overtime rules. The bill would also make enforcement and related rules apply to each workday as well as the week.
