Annual Medigap enrollment for Medicare recipients
If enacted, starting January 1, 2028, Medicare beneficiaries would be able to apply for any Medigap policy each year during Medicare’s annual election period. During that period, issuers could not deny coverage, require medical underwriting, or set prices based on health, claims, care received, or medical condition. If an issuer fails to follow these rules, existing enforcement rules in section 1882(s)(4) would apply. Within 30 days after enactment, HHS would update the “Medicare & You” and “Welcome to Medicare” notices to explain the change.
