Modern Worker Security Act
Sponsored By: Representative Kiley (CA)
In Committee
Summary
Stops portable benefits from counting toward whether a worker is an employee under federal law. The bill would require that any federal employee-status test ignore benefits provided in connection with work. It defines "benefit" to cover protections an individual can keep after leaving work, common full-time benefits like workers' compensation, training, paid leave, disability, health insurance, retirement savings, and short-term savings, and any contributions toward those benefits by an employer, the worker, or both. The bill would apply this rule to determinations under federal law and updates its title to reflect that change.

Benefits ignored when classifying workers
If enacted, this bill would require federal agencies and courts to decide whether someone is an employee without counting any "benefit" the person receives. Benefits would include protections a worker keeps after stopping work and things commonly given to full‑time staff, like health insurance, paid leave, retirement, training, workers' compensation, disability, and short‑term savings. Employer, worker, or joint contributions toward those benefits would also be excluded. The change would start on the date of enactment and would make it easier for businesses to treat people as contractors, which would reduce some worker protections tied to employee status.
