Federal rules override state repair laws

This bill would prevent states or localities from enforcing laws that conflict with this Act or its regulations on vehicle data and repair. Federal rules and regulations under the bill would override state and local measures in areas the bill covers.

Equal access to vehicle data and repair

This bill would require manufacturers to give owners and their chosen designees the same access to vehicle-generated data and repair information as dealers. Access would include vehicle interface ports like OBD and J-1939 and wireless telematics where equipped. Data holders would only be able to use or transfer vehicle-generated data for diagnostics, repair, or related service unless the owner consents. Manufacturers could use de-identified data for research only under strict technical and contractual limits. If you ask in writing or online, a holder of your vehicle data would have to delete it within 72 hours, except for data kept for maintenance, accounting, or safety. Manufacturers would not be allowed to limit who you designate to access your data and could not require specific brands of parts or tools except for recalls or warranty repairs.

FTC enforcement and oversight for repair

This bill would let any person file a short complaint with the FTC about repair or data-access violations. The FTC would forward the complaint, get a written answer, and must finish investigations and issue a final order within five months. The FTC would set up an advisory committee within 90 days that must meet at least three times per year and send annual reports to the Commission. The FTC would also send Congress a report every two years summarizing investigations, orders, best practices, and legislative recommendations.
