HR1627119th CongressWALLET

TREATS Act

Sponsored By: Representative Norcross

Introduced

Summary

Authorizes telehealth evaluations to satisfy the in-person medical evaluation required to prescribe certain FDA‑approved medications for substance use disorder (SUD). It defines telehealth as a real‑time audio‑only or audio‑plus‑video visit under Social Security Act section 1834(m) and keeps the change subject to Federal and State law.

Show full summary
  • People with SUD could receive remote evaluations that count toward the in‑person requirement when clinicians prescribe medications in Schedules III, IV, or V.
  • Practitioners, not pharmacists, would be allowed to perform these telehealth evaluations when they follow applicable Federal and State laws.
  • The bill requires use of systems that support two‑way, real‑time interactive communication and explicitly permits audio‑only or audio‑plus‑video interactions under the section 1834(m) standard.

Telehealth visits for addiction medicines

If enacted, you could use one telehealth visit as a medical evaluation to get certain addiction treatment medicines. It would apply only to FDA‑approved Schedule III, IV, or V drugs for substance use disorder. You would still need at least one in‑person medical evaluation. Audio‑only phone or audio‑and‑video calls would count if done under federal and state law by a practitioner (not a pharmacist). This would take effect upon enactment.
