Summary
Temporary Protected Status for Venezuelans. This bill would designate Venezuela for Temporary Protected Status under the Immigration and Nationality Act for an initial 18-month period commencing on the date of enactment. Venezuelan nationals who are continuously physically present in the United States from that date, who are admissible and not statutorily ineligible, and who register as the Secretary of Homeland Security directs would be deemed to meet TPS eligibility. The Secretary could permit brief emergency travel for TPS recipients, charge a $360 application fee for those eligible only under this designation with a waiver option, and would require PAYGO budgetary treatment.

18-month temporary protected status for Venezuelans
This bill would give Venezuelan nationals in the U.S. Temporary Protected Status (TPS) for 18 months starting on enactment. To qualify, you would need to have been continuously in the U.S. since that date, be admissible, not be otherwise ineligible, and register with DHS. If granted TPS, you would be protected from removal and could apply for work permission.
Emergency travel for Venezuelan TPS holders
If enacted, DHS would have to give prior consent for a short, emergency trip abroad if you have TPS under this Venezuela designation and show emergency and extenuating circumstances beyond your control. If you return with that consent, you would be treated like other returning TPS holders for reentry.
New $360 TPS fee for Venezuelans
If enacted, DHS could charge $360 for each TPS application filed by someone only eligible because of this Venezuela designation. This fee would be in addition to any other required fees. You could apply for a fee waiver. The fee would apply during the 18-month designation period starting on enactment.
