Commerce can verify chip location
If enacted, the Commerce Department would be authorized to verify the ownership and location of covered exported chips and to keep a record of each covered product, including current location and end‑user. The Secretary could require licensees to provide the information needed to maintain that record. This would expand Commerce oversight and add reporting and data‑provision duties for exporters and license holders.
New rules for exported chips
If enacted, the bill would require covered integrated circuits and certain computing products to include a location‑verification chip security mechanism within 180 days of enactment. "Covered" products are defined by specific export categories (ECCNs 3A090, 3A001.z, 4A090, 4A003.z, and similar successors). People holding export licenses would have to promptly report credible information if a product is in the wrong place, sent to the wrong user, or was tampered with. Makers and exporters would likely need to add features and face new compliance costs.
Study and require extra chip safeguards
If enacted, the Secretary of Commerce would complete an assessment within one year to identify additional chip security mechanisms (beyond location verification). The study would analyze feasibility, reliability, tamper resistance, performance impacts, and estimated costs to circumvent protections at scale, and would be reported to Congress in unclassified form with an optional classified annex. If new mechanisms are chosen, the Secretary could require covered products to include them no later than two years after the assessment is finished. Follow‑up assessments would run annually for three years starting not sooner than two years after enactment, and privacy and confidentiality would be prioritized.
