HELP Copays Act

Summary
This bill would require that payments from nonprofits and prescription drug manufacturers that cover patient copays and other cost sharing be counted toward deductibles, copayments, coinsurance, and out-of-pocket limits. It also creates a safe harbor so that counting that assistance does not cause a plan to lose High Deductible Health Plan status for Health Savings Account eligibility.

Count drug help toward cost-sharing
If enacted, this bill would require plans to count money paid by or for you toward your deductible and out-of-pocket limit. That includes help from nonprofit groups and prescription drug manufacturers for outpatient and specialty drugs. If enacted, counting that help would apply to group and individual plans for plan years beginning on or after January 1, 2026. The bill would also say that using such help to meet your deductible would not by itself make a plan lose its high-deductible health plan status for HSA eligibility for plan years beginning after December 31, 2025. Plans could still use prior authorization and step therapy.
